The Ghana Bar Association (GBA) has expressed strong reservations about the Attorney General’s (AG) choice of words in describing the Appeals Court’s verdict in the ambulance procurement case as “perverse”, “grossly unfair”, and “erroneous”.
In an interview with Joy FM, GBA’s Public Relations Officer, Saviour Kudze, questioned the AG’s use of such strong language, asking if he would have used similar words if the decision had gone in his favor.
Kudze emphasized that as the leader of the Bar, the AG’s words were unwarranted and set a bad example.
He suggested that the AG could have simply expressed disagreement with the verdict and announced plans to appeal without resorting to derogatory language.
The Court of Appeal on Tuesday, July 30, acquitted and discharged former Deputy Finance Minister, Dr. Cassiel Ato Forson, and businessman Richard Jakpa, in a case of alleged financial loss to the state.
In a 2-1 majority decision, the court ruled that the trial judge, Justice Afia Serwah Asare-Botwe, erred in her decision to call on the accused to open their defense on March 30, 2023.
Justices Kweku Tawiah Ackaah-Boafo and Philip Bright Mensah granted the appeal, acquitting and discharging the accused, while Presiding Judge, Justice Poku Acheampong, dissented.
