Court bars UCC Vice-Chancellor Prof. Johnson Nyarko-Boampong from office

A Cape Coast High Court has granted an interlocutory injunction restraining Professor Johnson Nyarko-Boampong from acting as Vice-Chancellor of the University of Cape Coast (UCC).

This comes after a legal challenge by John Mevemeo, who argued that the university’s governing council exceeded its authority by renewing Prof. Nyarko-Boampong’s appointment beyond the statutory retirement age of 60, in contravention of the 1992 Constitution and UCC statutes.

His lawsuit sought to nullify the renewal decision, citing violations of Article 199(1) of the Constitution and statutes 8.15 and 8.16 of the UCC Statutes 2016.

The plaintiff contends that the renewal should be declared null and void.

The court deferred its reasons for granting the application to Thursday, September 5, 2024.

Prof. Nyarko-Boampong’s initial four-year term was set to end on July 31, 2024, but the UCC Council renewed his appointment for another term, which the plaintiff argues is illegal since the Vice-Chancellor will exceed the statutory retirement age of 60.

The university and Prof. Nyarko-Boampong’s legal team have vowed to challenge the court’s decision, announcing plans to file an appeal and request a stay of execution to suspend the injunction’s implementation while the ruling is reviewed.
