Court directs OSP to give Cecilia Dapaah’s seized properties back to her

The Office of the Special Prosecutor has been directed by the High Court in Accra to give Cecilia Dapaah, the former Minister of Sanitation, back any property that has been taken from her home within seven days of Thursday, August 31, 2023.

This came about after the Court, presided over by Justice Edward Twum, determined that the OSP had violated the law when it used its authority to search the former minister’s home.

The court ruled that the OSP had broken legal requirements before issuing orders to take properties it believed to be “suspected tainted property” with corruption.

The court also found that because the OSP filed the seizure orders after the 7-day deadline and failed to file the application within that time, the court was unable to support it.

According to the court, the seizure was carried out on July 24 while the application was filed on August 8, a difference of 14 days and a blatant disregard for the constitutionally mandated 7-day waiting time.
