The Tema High Court has convicted the owner of Devtraco Limited for contempt of court after the company defied a lawful order and proceeded to develop a disputed parcel of land at Miotso, near Central University in the Ningo Prampram District.
The land, measuring approximately 2.44 acres, is legally owned by Sky Limit Structure Builders Limited. The company had filed an application to restrain Devtraco from developing the land, citing unlawful encroachment. On May 14, 2025, the court, presided over by Justice Malike Awo, granted an injunction prohibiting any development on the said property.
Despite the court order, Devtraco reportedly continued construction on the site, prompting legal action for contempt. According to court findings, the company ignored the order for several days, continuing construction even a week after the directive was issued.
In court on Tuesday, counsel for Devtraco pleaded for clemency, arguing that the conviction could disrupt the company’s ongoing 24-hour affordable housing project. The lawyer urged the court to consider the broader social benefits of the project and asked that the owner be cautioned rather than punished.
Justice Awo granted the request for mitigation, issuing a stern caution to the Devtraco owner while adjourning the case. The judge warned that any future acts of contempt would attract more severe consequences.
Sky Limit Structure Builders maintains that it legally acquired the land and has documents to prove ownership. The company says Devtraco’s actions represent not only a disregard for legal processes but also a threat to property rights and investor confidence in the real estate sector.
The case has reignited public debate over land ownership disputes and developer conduct in Ghana’s growing real estate market.
