Estate Dispute Over Daddy Lumba Moves to Court of Appeal

Akosua Serwaah has lodged an appeal before the Court of Appeal, Kumasi, against the judgment of the High Court which declared both herself and Priscilla Ofori, also known as Odo Broni, as the lawful surviving spouses of the late highlife musician, Charles Kwadwo Fosu, popularly known as Daddy Lumba.

In her Notice of Appeal, the appellant is challenging the entirety of the High Court’s decision, contending that the trial court erred in law when it rejected and ruled inadmissible a marriage certificate she tendered in support of her claim to sole spousal status.

She further argues that the High Court wrongly applied the provisions of the Evidence Act, 1975 (NRCD 323), in holding that she failed to satisfy the statutory requirements for the admission of the said marriage certificate into evidence.

Consequently, the appellant is seeking an order from the Court of Appeal setting aside the judgment of the High Court and a declaration that she is the sole lawful surviving spouse of the late musician.

On November 28, 2025, the Kumasi High Court, presided over by Justice Dr Dorinda Smith Arthur, dismissed the suit filed by Ms Serwaah, in which she sought a declaration that she was the only surviving spouse of Daddy Lumba.

The court held that the plaintiff failed to establish that she was married to the deceased under the Marriage Ordinance in a manner that would confer exclusive spousal status.

The High Court found that the evidence before it demonstrated that the deceased contracted a customary law marriage with Akosua Serwaah, a form of marriage recognised as potentially polygamous under Ghanaian law. Accordingly, the court held that the subsequent marriage between the deceased and Priscilla Ofori, alias Odo Broni, was valid.

In its final determination, the High Court declared both Akosua Serwaah and Priscilla Ofori, also known as Odo Broni, as the legally recognized surviving spouses of the late highlife icon.
