Former NDC MP Wants Article 71 Totally Deleted From Ghana’s Constitution

Former Member of Parliament for Tamale Central and former Minister for Lands and Natural Resources, Inusah Fuseini is advocating for the total deletion of Article 71 from Ghana’s 1992 Constitution.

According to the lawyer and former Chairman of the Legal and Constitutional Committee of Parliament, Article 71 is inconsistent with Article 17 of the constitution.

He explained that Article 71 has created a form of discrimination among public officeholders which is an affront to Article 17 which calls for equality for all.

Speaking on Accra-based JoyNews, Inusah Fuseini cannot fathom why some public officials should be set aside for preferential treatment to the detriment of others.

To correct the anomaly, the lawyer is calling for the total abolishment of Article 71 from the constitution.

“Article 71 should be deleted in its entirety because it appears to me to be it is inconsistent with article 17 of the constitution, which deals with non-discrimination. All officers under article 71 are public officers, and so there should not be discrimination between the Article 71 office holders and all other office holders,” the former Member of Parliament stated.

Article 71 of the Constitution of Ghana, spells out that the salaries and allowances of Article 71 office holders, be determined by the President, on the recommendations of a committee of not more than five persons appointed by him and acting upon the advice of the Council of State.

The Article 71 officeholders include the President, the Vice-President, the Speaker of Parliament, the Chief Justice, and the Justices of the Supreme Court.
