Here Is How One Can Protect Assets Gained In Marriage From Being Shared Upon Divorce – Lawyer Reveals

After it has become apparent that it is difficult in Ghana to hide properties acquired during marriage to avoid division upon divorce, a private legal practitioner has revealed that there is leeway out for people within this quagmire.

According to Lawyer Iris Aggrey-Orleans, a partner at Beyuo and Co., the strategy of Achraf Hakimi cannot stand the test of the law in Ghana based on the principle of joint efforts and trust.

Speaking on Accra-based JoyNews’ The Law on Sunday, the lawyer revealed that the best way partners can protect their properties acquired during the course of the marriage is to sign a prenuptial agreement.

A prenup, or prenuptial agreement, is a contract between two people that’s created before they get married. It typically lists each person’s assets, debts, and outlines how they’ll be handled should the couple divorce later on.

Prenups can be a valuable financial tool. While they may be difficult to think about while planning a wedding, prenups can provide comfort in knowing you’ll be protected.

Lawyer Aggrey-Orleans further revealed that another way is to be honest with your spouse. She explains that any partner who wants to solely own property should be honest with the other partner to get his/her consent first.

She again admonished that if the marriage is such that one cannot achieve his/her desires, it’s better to leave the marriage before the acquisition and development of properties commence.

“I think that basically, one must be honest with the spouse. If you intend to own property alone just state it. If you think that the marriage you are in is such that you cannot safely own property and you want to own property and you want to own it alone, just be honest and leave,” Ms Aggrey-Orleans advised.
