The Supreme Court has unanimously overruled an objection raised by counsel for the applicant Godfred Yeboah Dame regarding the constitution of a panel to hear a case challenging the processes to remove Chief Justice Gertrude Torkornoo.
A five-member panel, led by Acting Chief Justice Paul Baffoe Bonnie, cited Article 144(6) of the Constitution as the basis for their decision.
The panel had earlier suspended proceedings to consider the Godfred Dame’s concerns.
Godfred Dame had argued that having an acting Chief Justice chair the panel could undermine public confidence in the judiciary, given the potential personal benefits.
However, Deputy Attorney General Dr. Srem Sai countered that it was standard practice for seniormost judges to constitute and chair such panels.
With the objection overruled, the case will proceed with the current panel.
