Ghana Police Service to pay GHC100K for non-compliance with RTI request

An Accra Court has fined the Ghana Police Service GHC100,000 as damage over its failure to comply with the Right to Information access, enshrined in the constitution under Article 21(1)(f).

The ruling of the court comes on the back of an application filed by the Commonwealth Human Rights Initiative (CRI) to the Ghana Police Service, requesting a piece of two-fold information regarding the unlawful killings and brutalities by police officers over a specific period, which the Ghana Police Service failed to respond within 14 clear days after the request.

The Ghana Police Service is expected to make payments to the applicant, Commonwealth Human Rights Initiative (CRI) within 14 days or a 10 per cent penalty will be accrued after the deadline.

According to the court, “the posture by the Ghana Police Service, constitutes a failure to perform its obligation under Act 989 and an affront to the right of access to information”.

The Commission also ordered the Inspector General of Police to ensure that the pieces of Information are released to the applicant not later than 14 days after the decision.

It is also the case that the Ghana Police Service makes available the requested information on or before June 20, 2023.
