Court of Appeal throws out Rev. Kusi Boateng’s application against Ablakwa

The Court of Appeal dismissed an application filed by Rev. Victor Kusi Boateng, seeking to restrain Samuel Okudzeto Ablakwa, Member of Parliament for North Tongu, from discussing him concerning the National Cathedral project on Wednesday, June 26.

This is the third time Rev. Kusi Boateng has lost a suit against the North Tongu MP, with the court awarding Ablakwa GH¢3,000 in costs.

The court ruled that the grounds of appeal filed by Rev. Kusi Boateng’s lawyers failed to comply with the rules of the Court of Appeal, describing them as “incompetent and inadmissible”.

Before the ruling, the court had dismissed an objection raised by Ablakwa’s lawyers against the constitution of a new panel, describing the claims as “speculative innuendo”.

Rev. Kusi Boateng’s lawyers had alleged that the High Court judge who dismissed a contempt application by their client had been transferred from Accra to Sunyani and then to Bolga, suggesting that it could be due to their client’s affinity with the person who constitutes the panel.

However, the court upheld the argument by Ablakwa’s lawyers that the allegations were based on hearsay and not grounded in law, describing them as “unfounded”.
