Dela Sky Challenges anti-gay bill at Supreme Court

 

A lawyer and media personality has filed a suit at the Supreme Court to stop the implementation of a law that bans LGBTQ activities and their supporters in Ghana.

Richard Dela Sky, a private legal practitioner, argues that the Human Sexual Rights and Family Values Bill, also known as the anti-gay bill, is unconstitutional and violates the rights and freedoms of Ghanaians.

He says the bill, which was passed by Parliament on February 28, 2024, infringes on Articles 12, 15, 17, 18, and 21 of the 1992 Constitution, which guarantees equality, dignity, privacy, and expression for all citizens.

He also accuses the Speaker of Parliament of breaching Article 108 of the Constitution, which prohibits Parliament from passing laws that impose charges on public funds, without the prior approval of the President.

The bill, which awaits the President’s assent, criminalises same-sex relationships and imposes harsh penalties for anyone who engages in or promotes LGBTQ activities, advocacy, or funding.

President Nana Addo Dankwa Akufo-Addo has said he will wait for the Supreme Court’s verdict before making a decision on the bill.

Sky is seeking a declaration from the Supreme Court that the bill is null and void, and an order restraining the President from signing it into law.

He is also asking for an injunction to prevent any attempts to enforce the provisions of the bill, which he says are discriminatory and oppressive.“`
